Terms and Conditions for Digital Dive Marketing Management (Digital Dive)

These Terms and Conditions (“Terms”) govern your use of the website https://digitaldive.ai/ (the “Website”) and the services offered by Digital Dive “Digital Dive Marketing Management”, “DigitalDive.ai” (“we,” “us,” or “our”), a company based in Dubai, United Arab Emirates.
1. Acceptance of Terms
By accessing or using the Website, you agree to be bound by these Terms. Your continued use of the Website constitutes your ongoing acceptance of these Terms.
2. Use of the Website
You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Website in a way that could damage, disable, overburden, or impair the servers or networks of DigitalDive.ai.
- Attempt to gain unauthorized access to the Website or any account, computer system, or network connected to the Website.
- Interfere with any other user’s use of the Website.
- Upload content that is infringing, obscene, defamatory, threatening, or otherwise unlawful.
3. User Content
You may submit content, including images and text, to the Website (collectively, “User Content”). You retain all ownership rights to your User Content. However, by submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and translate your User Content for the purpose of operating and improving the Website.
You represent and warrant that you have all necessary rights and licenses to submit User Content and that your User Content does not infringe on any third-party rights.
We reserve the right to remove User Content that we believe violates these Terms or our policies.
4. Takedown Requests
If you believe that any User Content on the Website infringes on your copyright, you may submit a takedown request to [[email protected]] following the Digital Millennium Copyright Act (“DMCA”).
5. Money Back Guarantee (Limited)
We offer a limited money-back guarantee on our services, subject to the following conditions:
- The guarantee is only valid for contracts with a minimum duration of one (1) year.
- You can only avail the money-back guarantee if you haven’t generated revenue that is equal to or more than 80% of the total service charge you paid us.
- The guarantee applies only to the service charges and does not include any advertising costs, tool fees, server fees, or other pre-paid expenses.
To claim the money-back guarantee, you must submit a written request to [[email protected]] within 30 days of contract termination. Your request must include a detailed explanation of why you are unsatisfied with the service and any supporting documentation to demonstrate that you haven’t generated sufficient revenue.
We will review your request and respond within a reasonable timeframe. If we approve your request, we will refund the remaining service charge (excluding any non-refundable fees) within 30 days.
6. Content Removal
We reserve the right to remove any User Content from the Website at any time for any reason. We will make a reasonable effort to remove User Content upon receipt of a proper communication to [[email protected]] requesting such removal, provided that such request complies with applicable law. However, we are not obligated to remove any User Content upon request.
7. Disclaimer
The Website and the services offered by DigitalDive.ai are provided “as is” and without warranties of any kind, express or implied. We disclaim all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Website will be uninterrupted or error-free, that defects will be corrected, or that the Website will be free of viruses or other harmful components.
8. Limitation of Liability
In no event shall DigitalDive.ai, its officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Website, the services offered by DigitalDive.ai, or your User Content, even if we have been advised of the possibility of such damages.
9. Termination
We may terminate your access to the Website and any related services at any time, with or without cause, upon written notice. You may also terminate your access to the Website by discontinuing your use.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Emirate of Dubai, United Arab Emirates, without regard to its conflict of laws provisions.
Any dispute arising out of or relating to these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.
